on insight

From an article in The New Republic (which, as you can tell, I read fairly regularly):

The authenticity argument contains a grain of truth. Obviously an experience--be it of racism, farming, or war--can provide insight into the policy debates surrounding it. But the key word is insight. Experience carries weight only to the degree that it produces better arguments. Sometimes it does not--because personal experience is too narrow and idiosyncratic to shed light on broad debates. And sometimes the most important insights come secondhand, from studying the multiple experiences of others.

How does this, and how should this affect how we approach the law? Some argue that it changes everything, others argue that it changes nothing. This excerpt, to me, seems to present a pretty good balance (though in generalities, yes, in generalities). But then I tend to be an eclecticist with regards to my approach to the law; I tend to lack "paradigmatic loyalty." So.

being edited

So I'm involved with a class at Georgetown Law now.(*) The second half (it goes over two semesters, though neither is required to take the other) is called "Applied Scholarly Editing," and the purpose of it is to teach editors on law student journals how to edit "better." But what does "better editing" mean? Does it mean just fixing grammatical mistakes and fact checking? Does it extend to interactions with authors and with fellow student editors/bluebookers/note writers? We try to address all these things in the class, though there's only a short amount of time in which to do so. But we hope it'll be a good start.

One of the things we try to do is give the author's perspective, because it's nice to remind (or be reminded) people that yes, there's a real person at the other end of a paper. Last time, we got Steven Goldberg and Mark Tushnet and Vicki Jackson to speak about their experiences (good and bad) being edited by student law journals.

But one critique of this part of the course is that it's relatively anecdotal. There should be a more systematic way of presenting "the author's perspective." I'm trying to figure out how to do this. If anyone reading this blog has any ideas, they should email me.

(*) I developed the syllabus while in law school, and now that I've graduated, I've still been hanging around and helping with the development of the class, which is still new. But the earlier seminar (the first in this two-part series), Introduction to Scholarly Editing, got rave reviews!

revisiting the purpose of this page

As I mentioned earlier on this page, I've decide to put entries involving my personal life on my livejournal page. I'm liking livejournal because it allows me to lock all my entries so only my friends can read it(*), which in turn gives me some of the privacy that I've been looking for while allowing me to continue recording my life to my obsessive-heart's content.

In the meantime, I've been trying to figure out what to do with this page. Is it just for links? Do I let it decay? What's it for?

Anyway, what I've decided is that I'll keep this one around for legal commentary, if I ever get around to writing such stuff regularly. It'll probably be short legal commentary, with an emphasis on the commentary part. Or questions, that'll work too. And it'll probably talk about lawyer culture and law school culture, because, hey, that stuff interests me as well. We'll see how it goes. It might mutate.
