just got back
from a roundtable on the World Summit on Sustainable Development. The roundtable was sponsored by my former law journal, the at the Georgetown University Law Center. While the roundtable itself was quite informative, and even jovial (esp. for an international law symposium, which can get rather dry), I have to admit, I left a little depressed. Details to follow eventually.

Bryan Garner, author of my favorite style guide (and, er, editor of the most recent version of Black's Law Dictionary, is friends with David Foster Wallace, author of some of my favorite books. It is a small, small world. Though sadly enough, Bryan Garner's fiction is not getting published, despite his many legal publications. But I'm so very very curious!

On the recent California decision discussing rape and the withdrawal of consent during intercourse. I usually like reading Sherry Colb's columns, but here, as with many feminist discussions regarding rape (note: I'm not saying all!), I have a cringey, grimacing reaction to how rape gets discussed solely in terms of males raping females, because it ignores instances of males raping males, females raping males, and, yes, females raping females. This happens to be, by the way, why I cannot sit through most conferences discussing these things.
Unlike various queer legal theorists, though, this does not bother me enough to want them to change the terms of the discussion---I understand the simplicity in being able to frame arguments in terms of male/female (and use different pronouns! so much easier), and I even agree that that encompasses the majority of rape scenarios. Moreover, my legal attention is mostly focused on the environmental arena.
But I personally can't deal with discussions framed in this way. Can't.
Nor can I deal with this statement of hers: "In fact, it may be precisely the desire to dominate and punish a woman who has behaved like a 'tease' that motivates men to force them to continue to have sex after consent has been unambiguously withdrawn. In that sense, the sexual act that proceeds after a woman's withdrawal of consent is no longer truly the 'same' act as that which took place while her partner still had consent." I agree that that could very well be the motivating factor in some instances of rape. But oftentimes when that statement (which, by the way, is not limited to Colb) is made it's used in such a way to imply that this motivation--related to the power of one gender over another--is enough to explain all instances of rape. Which it can't, not if same-sex rape is to be explained.
Sorry to go off on a tangent. I'm actually pretty sure (or at least hope) that Professor Colb's approach is more nuanced than that; after all, she's written many articles on sexual-orientation discrimination as well. But it still bugs me. You know.
